Early analysis of our new Torture Statute
Some excellent analysis of our new Torture Statute is out:
- Analysis: Many Rights in U.S. Legal System Absent in New Bill, a nice, accurate rundown by the Washington Post, which quotes Sanford Levinson at Balkanization calling the bill a mark of a "banana republic", and Yale Law School Dean Harold Koh saying that "the image of Congress rushing to strip jurisdiction from the courts in response to a politically created emergency is really quite shocking, and it's not clear that most of the members understand what they've done";
- a critical analysis signed by 609 law professors;
- analysis from Aziz Huq;
- analysis by Jack Balkin; and
- a few comments by Glenn Greenwald on the Senate passage of the bill.
