Early analysis of our new Torture Statute

Some excellent analysis of our new Torture Statute is out:

• Analysis: Many Rights in U.S. Legal System Absent in New Bill, a nice, accurate rundown by the Washington Post, which quotes Sanford Levinson at Balkanization calling the bill a mark of a "banana republic", and Yale Law School Dean Harold Koh saying that "the image of Congress rushing to strip jurisdiction from the courts in response to a politically created emergency is really quite shocking, and it's not clear that most of the members understand what they've done";

• a few comments by Glenn Greenwald on the Senate passage of the bill.

On the other hand, the NY Times and Washington Post editorial pages are both silent on the matter. I can only assume, because they just commented on this right before the Senate took it up, and they are saving up post-passage whoppers for their Sunday editions.
